Sidekitt Terms of Service

1. Introduction

Welcome to Sidekitt. These Terms of Service ("Terms") govern your access to and use of the website located at [sidekitt.com.au] (the "Site"), and any purchase you make through it. Sidekitt is operated by [Sidekitt Pty Ltd / your registered entity name] (ABN 90 591 520 279), based in Edgecliff, New South Wales, Australia ("Sidekitt", "we", "us" or "our").

By accessing or using the Site, placing an order, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or purchasing under the supervision of a parent or guardian, to place an order with us. By using the Site, you confirm that you have the legal capacity to enter into a binding contract.

3. Products

We sell premium dog outerwear, including but not limited to jackets, coats, ponchos and related accessories. We make reasonable efforts to display product colours, materials and details accurately, but we do not guarantee that your device's display will reflect the exact colour of the product. Product descriptions, sizing guides and images are provided as a guide only.

We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion, including where a product is listed at an incorrect price due to a technical or human error.

4. Pricing and GST

All prices on the Site are listed in Australian Dollars (AUD) and, unless otherwise stated, are inclusive of Goods and Services Tax (GST) for Australian customers. Prices are subject to change without notice, though changes will not affect orders that have already been confirmed.

Shipping costs, and any duties or taxes applicable to international orders, are calculated and displayed separately at checkout.

5. Orders and Payment

When you place an order, you are making an offer to purchase the relevant product. We will send you an order confirmation email, which does not itself constitute acceptance of your order. A contract of sale is only formed once we confirm that your order has been processed for dispatch.

Payment is required in full at the time of ordering. We accept the payment methods displayed at checkout. By providing payment details, you confirm that you are authorised to use the relevant payment method.

We reserve the right to cancel or refuse any order, including where we suspect fraud, where a product is unavailable, or where an error has occurred in pricing or product information. If we cancel an order after payment has been taken, we will provide a full refund.

6. Shipping and Delivery

We aim to dispatch orders within 2 to 3 business days of purchase. Delivery timeframes provided at checkout are estimates only and are not guaranteed, as they depend in part on our courier partners.

Risk in the products passes to you once the order has been delivered to the address provided at checkout. Please ensure your shipping details are accurate, as we are not responsible for orders delayed or lost due to incorrect address information.

For international orders, you are responsible for any customs duties, taxes or import fees charged by your country's authorities. These are not included in our listed prices.

7. Returns, Exchanges and Refunds

7.1 Change of mind

If you change your mind, you may return eligible products within 21 days of delivery, subject to the conditions set out in our Returns & Refund Policy, including item condition, packaging, tags and proof of purchase requirements. A return shipping fee applies to change of mind returns, as set out in that policy.

7.2 Your rights under Australian Consumer Law

Nothing in these Terms restricts, limits or modifies your rights under the Australian Consumer Law (ACL). Our products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

If a product you receive is faulty, not as described, or does not do what it is meant to do, please contact us at hello@sidekitt.com.au and we will work with you to arrange a repair, replacement or refund in accordance with the ACL.

7.3 Refund method

Approved refunds are issued to your original payment method, or as store credit where selected, in accordance with our Returns & Refund Policy. Processing timeframes are set out in that policy.

8. Cancellations

If you wish to cancel an order, please contact us at hello@sidekitt.com.au as soon as possible. We will do our best to accommodate cancellation requests, but we cannot guarantee cancellation once an order has entered fulfilment or been dispatched.

9. Intellectual Property

All content on the Site, including but not limited to the Sidekitt name, logo, product designs, photography, graphics, text and website layout, is owned by or licensed to Sidekitt and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify or otherwise use any content from the Site without our prior written consent.

10. Use of the Site

You agree to use the Site only for lawful purposes. You must not:

• attempt to gain unauthorised access to the Site or its systems
• interfere with the proper functioning of the Site
• use the Site to transmit harmful code or engage in fraudulent activity
• copy, scrape or reuse content from the Site for commercial purposes without our consent

We reserve the right to suspend or restrict your access to the Site if we reasonably believe you have breached these Terms.

11. Third Party Links

The Site may contain links to third party websites, including social media platforms and payment providers. We are not responsible for the content, accuracy or practices of any third party site, and your use of those sites is governed by their own terms and privacy policies.

12. Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, Sidekitt's total liability to you arising out of or in connection with these Terms or your use of the Site is limited, at our option, to the resupply of the relevant products or services, or the cost of resupplying them.

To the extent permitted by law, we exclude all liability for any indirect, incidental or consequential loss arising from your use of the Site or products purchased through it.

13. Indemnity

You agree to indemnify and hold Sidekitt, its founders, employees and contractors harmless from any claim, loss, liability or expense arising from your breach of these Terms or your misuse of the Site.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and store your personal information in accordance with the Privacy Act 1988 (Cth). Please review our [Privacy Policy] for further detail.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations where that delay or failure results from circumstances beyond our reasonable control, including natural disasters, courier disruptions, supplier delays or other events of force majeure.

We may update these Terms from time to time to reflect changes in our business or legal requirements. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in respect of any dispute arising from these Terms.
